Details

Product fee$75
$75/product for pet food in packages of 10 lb and under ($40 registration + $35 WV Spay Neuter Assistance Fund surcharge), expires Dec 31; $100/product for packages over 10 lb or bulk ($50 + $50 surcharge), expires Aug 31; specialty pet food (non dog/cat) $40/product, expires Dec 31. A product sold in both ≤10 lb and >10 lb sizes must be registered in both categories.
Product late fee$100 late penalty if not applied for 15 days before expiration (or before starting business); fees set by statute, agency says it cannot waive
Renewal windowRegistration period Jan 1 – Dec 31 (≤10 lb products); registrations expire Dec 31 but 'must be applied for 15 days prior to expiration or will be subject to a late fee of $100.00' (agency page + instructions; statute 19-14-5(b) says 30 days) — so the practical due date is Dec 16. Products >10 lb/bulk expire Aug 31 (apply by Aug 16).
Exempt
  • Raw meat pet food if the meat is not processed and not mixed with other materials
  • Pet chew, bone, toy or exerciser made of rawhide, wood or man-made material (flavor-coated or not) unless the label claims it is animal food or has nutritional value
Tonnage noteNo inspection fee or semi-annual report for persons exclusively manufacturing/distributing pet food or specialty pet food (WV Code 19-14-9(a)(5), (c)). Tonnage applies only to holders of manufacturing, distributor, or large-package commercial feed permits.

Forms

Good to know

  • Two pet-food expiry dates: ≤10 lb products expire Dec 31; >10 lb/bulk products expire Aug 31. Small treat brands only care about Dec 31.
  • $35 of the $75 fee is a Spay Neuter Assistance Fund surcharge; the current code text (19-14-5(g), read today) has no sunset (2025 SB 578 text proposed 'until June 1, 2027' — watch for a fee drop to $40 if a sunset is reinstated).
  • Different treat sizes (small/large/jumbo) are separate products; same product in 3 lb and 5 lb is one small-package registration.
  • 3 oz biscuits sold in bulk (non-packaged) register as Large Package.
  • Label changes require a new application before distribution; fee waived for net-weight or ingredient-list revisions (Rule 61-5-5.4.h).
  • Form has a 'Please Check Here if you are a new firm' box and a 'Plants ID' (WVPlants) field; a separate 'Address for Mailing Registrations' and 'Registration Contact Person' can differ from the corporate address.
  • Renewals can be paid online at WVPlants.wvda.us only by registered users holding the Plant ID + PIN printed on the certificate/renewal notice.
